The Tariff Commission issued this report pursuant to Section 16 of Republic Act Number 8800 (Safeguard Measures Act) which states that when a Safeguard Measure is imposed for more than one year, review and monitoring of the developments with respect to the affected domestic industry, including the progress and specific efforts made to make a positive adjustment to import competition has to be conducted.
After taking into consideration the domestic HDPE industry's compliance with its adjustment plan/s, the Commission finds that the imposition of the safeguard measure on imported HDPE pellets and granules can be said to have been helpful in providing support to the domestic industry. This is evidenced by the domestic industry's compliance with its commitments to make a positive adjustment to import competition and its implementation of measures to increase competitiveness. To date, it can be concluded that the Safeguard Measure was timely and proper, as it has provided breathing space for the domestic industry and has mainly contributed to its increasing competitiveness.
