Formal Investigation on the Imposition of Safeguard Measures Against Importations of Motor Vehicles (Passenger Cars and Light Commercial Vehicles) from Various Countries


The Tariff Commission issued this report to investigate the merits of imposing a definitive safeguard duty against importations of Motor Vehicles (Passenger Cars and Light Commercial Vehicles) from various countries pursuant to Republic Act (RA) No. 8800 (Safeguard Measures Act). In this investigation report, the Commission determined: (a) if the subject domestic product is a like or directly competitive product to the imported product under consideration; (b) if the imported product under consideration is being imported into the Philippines in increased quantities whether absolute or relative to domestic production; (c) presence and extent of serious injury of threat thereof to the domestic industry that produces like or directly competitive product; (d) existence of causal relationship between the increased imports of the product under consideration and the serious injury or threat thereof to the domestic industry. Taking into consideration all the above-mentioned elements, the Commission established that Completely Built-Up (CBU) passenger cars and CBU light commercial vehicles were not imported in increased quantities (whether absolute or relative to domestic production) during the period of investigation. The Commission recommends that no definitive general safeguard measure be imposed on importations of CBU passenger cars and CBU light commercial vehicles.
