From Laboratories to the Market: The Legal Regime for the Transfer of Government-funded Research to the Commercial Sector


This paper studied the Bayh-Dole Act of 1980, the first legislation to mandate a uniform and comprehensive federal implementation of the “title-in-contractor” policy in comparison with “title-in-government” policy, on facilitating the transfer of government-funded research results from universities to the commercial sector in the U.S. This paper explored the feasibility of adopting Bayh-Dole-like arrangements for projects funded by PCARRD and presented three legal pathways if PCARRD adopts arrangements similar to those in the Bayh-Dole Act.
