The Philippine IPR System and its Application to Biotechnology


This paper discusses the IPR system in the country and its application to biotechnology. Reference is made to modern biotechnology based on plant genetic resources and microorganisms. The country is trying to evolve a sui generis system of protection to newly developed plant varieties. National law on plant variety protection must consider concerns such as the protection of community and farmers’ rights, mechanisms on access, biosafety, specificity of protection coverage, benefits sharing, and the conservation and sustainable use of genetic resources.
